This agreement is governed by the laws of the state of North Carolina, ASA. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth below, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Use of this website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

Terms & Conditions:

Reserving or participating in any travel services offered by FAMtastic Tour (hereinafter “FAMtastic Tour  ” , “the company”, “we”, “us”) constitutes a contractual agreement between the travel agent/ advisor, its clients, tour participant, guests, family members or any other or any person travelling with us, mentioned here as  (“you”) (“your”) and “FAMtastic Tour” and is an acknowledgement that you have read, understand, and agree to be bound by all  these terms & conditions. You must be at least 18 years of age to make a reservation. In all cases, the person making the reservation represents and warrants that all participants have consented to, accepted, and agreed to be bound by these terms.
FAMtastic Tour   reserves the right to correct any errors or omissions and to amend these terms and conditions at any time as the result of any material changes to legislation or regulation. All amended terms and conditions shall automatically be effective upon being posted on our website. Accordingly, all are expected to check the content of our terms and conditions on our website prior to booking and prior to traveling or sending clients in order to ensure they are aware of any changes.
Any payment made to FAMtastic Tour shall be deemed to constitute full acceptance of these terms.

This website may include links to other 3^rd parties. We are not responsible, nor do we endorse the content or quality of any other websites.

 

Passports and Visas:

Passengers are responsible for ensuring that they have the proper travel documents and must check with the respective consulate(s) or visa agency to determine whether any visas or passports are required. Passports are required to be valid for at least 6 months beyond the dates of travel. Some countries require a full blank page in the passport for stamping purposes. It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, and any other requirements to be permitted entry into each destination. Your failure to have proper visas and/or passport, or other specified requirements  will likely result in you not being able to leave a country or enter a destination and no refund will be available in any such case and FAMtastic Tour  will have no liability in such case. Any information provided pertains to USA and Canada citizens only. Non-USA and non-Canada citizens should check with the respective consulate of the country(s) to be visited for current entry requirements.

 

Travel Protection:

We recommend Travel Protection that helps provide coverage for Trip Cancellation, Interruption, Baggage Loss or Delay, Medical Expenses and more. For better protection we advise to check that insurance must covers; trip interruption, personal injury, medical expenses, evacuation and repatriation cover including during pandemic events. You may check our Travel insurance for details and cost.

 

Prices:

Prices are per person based upon shared twin room occupancy. Prices do not include airfares, except where noted on specific itineraries, and are subject to change without notice. Prices do not include items of a personal nature such as laundry, wines, water, beverages, food other than the table-d’hôte menu, passport and visa fees, insurance, and foreign port taxes unless specifically indicated in the package inclusions (this list is illustrative and not a complete list of every item not included.). Prices are correct at time of publication; however, as airfares continually fluctuate and classes of service may have limited capacity, tour package prices and availability will change accordingly. Pricing for our trips and services are subject to change at any time prior to receipt of full deposit. Once FAMtastic Tour processes any payment for services, the price is guaranteed not to increase unless you amend your reservation.
• The prices of the tours are guaranteed, but if unforeseen circumstances beyond FAMtastic Tour’s control such as increased government taxes, significant increase in currency exchange rates, etc., FAMtastic Tour will adjust the price accordingly.
• Prices are subject to change due to fluctuation in currency exchange rate.

Deposits and Payments Policy:

To confirm the booking, at the time of reservation a deposit is required to confirm price and reservation.  (Unless it is mentioned otherwise in specific itineraries or programs).

• A deposit of $300 per person, per country booked is required upon booking the tour.
  • Final payment is due 75 days prior to departure.
  • If booking within 21 days of travel, an additional fee of $75 per person will apply.
  • A change fee of $50 per person will apply to any changes made by the traveler after confirmation has been sent.

* Travel protection (insurance) premiums are not covered by the initial deposit. We can provide it upon request.

* Flight tickets should be paid in full, as soon as requested/confirmed (cancelation and amendments are subject to airfare company).

 

Forms of Payments:

Us dollar check, bank check, money order, wire transfer, PayPal, major credit cards or debit cards.

All payments made within 25 days of departure must be made by credit or debit card. Credit card charges will be accepted by phone or online to fulfil non-refundable deposit requirement. Final payment will be processed upon submission of a completed FAMtastic Tour credit card form. Additional fees for credit card payment will be applied. Third-party credit cards are not acceptable. Payments made by wire transfer must include an additional $20 wire transfer fee. There is a $40 fee for returned or bounced check.

 

Last Minute:

All reservations must be made no later than 14 days prior to departure (unless mentioned otherwise in specific itineraries or programs).

If requested services cannot be confirmed, payment will be refunded. If services are confirmed, final payment is due on the spot and all applicable cancellation penalties will apply.

 

Refunds:

Refunds are processed to the credit card(s) originally used for payment, up to the total amount paid, with any remaining balance paid by US Dollar check.

 

Cancellation:

Once a partial or full payment has been made, cancellations will only be accepted in writing by email. If you do not receive an acknowledgement within 48 hours, call to ensure your information was received. Cancellation terms will be applied based on the date that the written cancellation is received and based on the following dates prior to departure. Cancellation fees apply to packages and/or services as indicated below. Noting that once airfare is purchased airline tickets will be issued. Air tickets are always subject to 100% penalty. Land packages cancellations will be subject to the fees below (unless mentioned otherwise in specific itineraries or programs).

• Up to 75 days prior to departure: $ 150 per person service fees per country will be applied.
• 74 to 61 days prior to departure: 25% of cost.
• 60 to 46 days prior to departure: 50% of cost.
• 45 to 30 days prior to departure: 75% of cost.
• 29 days or less prior to departure: 100% of cost.

No refund will apply to any unused services including but not limited to flights, accommodations, touring, meals and/or transportation.

 

Cancelation of Airfare & Rail Tickets:

• Airfare : 100% of airfare.
• Rail tickets  : 100% of rail tickets.

We reserve the right to cancel or reschedule any departure for any reason.  If we cancel, except in the case of extreme circumstances as detailed above, we will offer alternate arrangements.  We may at our sole discretion offer travel vouchers or refunds in accordance with our cancellation policy above.  You are responsible for any additional costs for air tickets or other travel arrangements not made by us.

 

Trip Member Health and Safety:

FAMtastic Tour assumes no liability or responsibility for any damages which may result from your participation in any activity during the trip. You participate in the activities of the trip at your own risk. Climbing, hiking, extensive walking, touring in general, use of various transportation and recreational vehicles, and other physical activity may involve greater risk of injury or death than the activities which you may participate in during your daily life. By taking part in such activities, you incur and assume all of the risks that such activities present. FAMtastic Tour is not qualified to evaluate your fitness, you (or your doctor) must evaluate your fitness for any given tour or activity. You may be required to sign waivers on or before the departure date.  Failure to sign waivers may prevent you from participating in the trip or from participating in specific trip activities. 

Client’s Waivers of Liability:

By booking with FAMtastic Tour , you understand that voluntarily traveling or arranging tours, trips and travel, sending clients, guests or family members to destinations in this website or elsewhere, and attending, a tour may involve certain risks beyond FAMtastic Tour  control, its officers, directors, volunteers, and agents, in connection with the tour. Such risks include, but are not limited to force majeure, accidents, emergencies, epidemics/pandemics, exposure to reckless conduct of other persons, and/or negligence of security, police, army and medical personnel. FAMtastic Tour   hereby disclaims any and all liability and responsibility for any or such risks. You understand that if during any time or break in the tour there may be an opportunity to participate in recreational or other activities, participants of the tours do so at their own risk and subject to all terms and conditions set by any recreational or other provider.

By accepting the terms and conditions, you agree and acknowledge that you may be giving up important legal rights and remedies available to yourself, your family, your heirs, successors, and assigns. For value received, you agree on behalf of myself, your heirs, successors, and assigns (“your behalf”) that you assume all risks and waive any claim of liability of any nature whatsoever against, and agree to indemnify and hold harmless, FAMtastic Tour with respect to any and all actions, claims or demands that may be made or brought on your behalf against FAMtastic Tour arising out of, or in connection with, travel to, or attendance at the tour or any other activity you may engage in while participating in the tour/event. Further, for value received, for any injury to third parties that may arise because of your own actions or omissions, you agree to indemnify, hold harmless and defend FAMtastic Tour with respect to any and all actions, claims, expenses or demands arising therefrom that may be made or brought against FAMtastic Tour, including but not limited to, reasonable attorneys’ fees and expenses arising in connection therewith.

Force Majeure and Responsibility Clause:

By utilizing FAMtastic Tour services you agree that FAMtastic Tour, its employees, officers, agents will not be liable for any force majeure event beyond the control of FAMtastic Tour, including but not limited to: earthquake, flood, fire, explosion, landslide, lightning, action of the elements, force of nature, washout, typhoon, hurricane, cyclone, tsunami, storm or storm warning or natural disaster, industrial disputes, work ban or other labor dispute or difficulty, acts of terrorism, political unrest, war or threat of war, riots or civil strife, failure or delays to scheduled transportation and the closure of airports or ports, pandemic, epidemic or health risk, governmental and administrative actions including closure of borders and travel warnings and restrictions, change in flight or itinerary schedule, strikes, delay, acts of governments, fires, riots, theft, pilferage, epidemics, quarantine, medical or customs regulations, accident, loss, injury, or damage to you or to those traveling with you in connection with any accommodations, transportation or any other services or resulting directly or indirectly from any occurrence or conditions beyond its control, including defects in vehicles, breakdown in equipment, thefts, delay or cancellation of, or changes in itinerary for any act, omission, or event during the time you are on tour, or on board the aircraft. Neither FAMtastic Tour and/or agents of the suppliers concerned are to be held responsible for the late arrival or departure on return of passengers at airports or hotels due to inclement weather or other reasons, nor are we to be held liable for payment or any refund for transfers or unused service, hotel accommodations or meals occasioned by such late arrivals at the hotels holding rooms as confirmed itineraries. Passengers must bear all such losses or expenses. To guard against unforeseen health or other circumstances, we recommend you purchase insurance. FAMtastic Tour is not responsible for circumstances beyond its control. In circumstances where trip cancellations resulting from the inability for trip to depart or operate as scheduled, such as cancellations due to acts of war and/or terrorism, war, force majeure, act of God, civil unrest, illness, disease, criminal or terrorist acts of any kind, or if natural disaster takes place, FAMtastic Tour , its employees and agents, are not liable for any restitution, and in addition, without limitation are not responsible for any injury, financial or physical loss, death, inconveniences, traumas, or damages with connection to any inclusions other provisions of any goods of services included.
There are inherent risks in travel as our tours go at times through remote locations, far from medical facilities. You are to assume all associated risks and complete responsibility, including illness, injury or even death by participating. You agree to indemnify and hold FAMtastic Tour   harmless, with respect to any claim made to FAMtastic Tour by anyone else which related to your participation.

 

Supplier Agreements:

FAMtastic Tour does not own, manage, control, run or operate any transportation or recreational vehicle (including any motor coach, boat, helicopter and/or airplane), hotel, restaurant, or any other supplier of services connected with a trip. All tour services are subject to the terms and conditions specified by the supplier of such service and to the laws of the countries in which the services are supplied.  The passage contract (conditions of carriage), when issued by the airlines concerned, shall constitute the sole contract between such airlines and the trip member.

 

Minors Travelling with, FAMtastic Tour:  

All minors under 18 must be accompanied by an adult. Most hotels do not permit children under 18 to occupy a room without an adult. By allowing a minor to participate in a FAMtastic Tour, the parents and/or guardian of the participating minor agree to be solely responsible for the supervision and welfare of the minor on the trip and to ensure that the minor follows all written and verbal rules of safety. Accompanying adults are responsible for the safety of their children including to provide any necessary safety equipment (such as infant/child seats) where appropriate. The parents and/or guardian of the participating minor, for themselves and on behalf of the participating  minor, hereby release and discharge, and agree to hold harmless, FAMtastic Tour   from and against any and all damages (including, without limitation, emotional trauma) suffered or incurred by such minor.

Please note that many countries have adopted practices to prevent international abductions of children. If a person under the age of 18 years will be travelling with an adult other than his/her parents, or with only one parent, a notarized letter written by both parents, or non-travelling parent, granting authorization to travel, including the dates of travel should be carried. If you are traveling as the guardian of child/children, we strongly suggest that you carry a letter from both parents of the child authorizing emergency treatment in the event of illness or accident. Please note that FAMtastic Tour is not responsible for the disruption of travel caused by improper documentation for children traveling without both parents.

 

Travelers Needing Special Assistance:

Special dietary requests: the restaurants, hotels, caterers and numerous other partners we work with all do their best to accommodate special dietary requests from you. However, given the diverse nature of those food providers (from small wineries to grand hotels to world-famous restaurants around the world, some of our partners are better able than others to accommodate such requests. We therefore cannot guarantee that all dietary requests can be accommodated at every meal.  Also, please note that where dietary requests can be accommodated, choices will frequently be limited.

 

Mobility: FAMtastic Tour regrets that it cannot provide special assistance for walking, wheelchairs, motorized scooters, dining or other personal needs.  If you need such assistance, you must be accompanied by an able companion who will assist you. We regret that some itineraries cannot accommodate wheelchairs or motorized scooters.  FAMtastic Tour may require you to produce a doctor’s certificate certifying you are fit partake in the trip. If FAMtastic Tour is unable to reasonably accommodate your needs or believes that your health and safety could be compromised, we reserve the right to refuse you a place on the trip.

 

Photography and Videography during Tours/Events/Services:                            

FAMtastic Tour reserves the right to take photographs and videos during the operation of any tour/event/service and to use them for its purposes thereafter. By booking with FAMtastic Tour, you agree to allow images to be used in such photographs and video. Guests who prefer that their images not be used are asked to advise us in writing at any time prior to departure and to identify themselves into their local tour guide at the beginning of the tours.
