These Terms & Conditions (“Agreement”) govern use of FAMtasticTour.com, FAMtastictours.com and all travel services provided by FAMtastic Tour / Famtastic Tours (“FAMtastic Tour,” “Famtastic Tours,” “Company,” “we,” “us,” or “our”).By accessing this website, submitting payment, authorizing a booking, or participating in any services, you agree to be legally bound by this Agreement.
These Terms apply to:
• Individual travelers (B2C)
• Travel advisors and agencies (B2B)
• Corporate clients
• Any party booking directly or indirectly
BUSINESS ENTITY DISCLOSURE
FAMtastic Tour and FAMtastic Tours are trade names (DBA – “doing business as”) of MGG Services, a North Carolina business entity. All contracts, bookings, payments, and legal obligations are entered into with MGG Services, operating under the trade names FAMtastic Tour and FAMtastic Tours.
Unless otherwise stated in a specific program or agreement, such materials may not be modified, reproduced, redistributed, or used to create, support, or promote any independent or competing travel products. Any use of these materials must accurately reflect the program as provided, including pricing, inclusions, and structure.
Access to certain materials, including detailed itineraries, co-branded content, and pricing, may be conditional upon partner validation, active engagement, or confirmed bookings. Famtastic Tours reserves the right to limit, withdraw, or restrict access to such materials at its discretion.
Any unauthorized use or misuse of marketing materials may result in restriction of access, cancellation of associated bookings or allocations, and termination of collaboration.
This website is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.
To the fullest extent permitted by law, we disclaim:
• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness
• Continuous or uninterrupted access
To the fullest extent permitted by law:
FAMtastic Tour / Famtastic Tours shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, emotional distress, or business interruption.
Liability Cap
In no event shall FAMtastic Tour / Famtastic Tours’ total aggregate liability exceed the total amount actually paid to FAMtastic Tour / Famtastic Tours for the specific booking giving rise to the claim.
This limitation applies regardless of legal theory.
Nothing herein limits liability where it is prohibited by law.
You agree to indemnify, defend, and hold harmless FAMtastic Tour / Famtastic Tours, its officers, directors, employees, affiliates, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney’s fees, arising out of or related to:
This provision survives termination.
FAMtastic Tour / Famtastic Tours acts solely as an intermediary for independent third-party suppliers, including airlines, hotels, cruise lines, ground operators, and transportation providers.
We do not own, operate, manage, or have any control these suppliers.
We are not liable for:
• Supplier negligence
• Supplier bankruptcy
• Mechanical failures
• Delays or cancellations
• Service interruptions
• Acts or omissions of suppliers
All services are subject to supplier contracts and applicable law.
The person making the reservation:
• Warrants they are at least 18 years old
• Warrants authority to bind all travelers
• Accepts these Terms on behalf of all participants
If a travel advisor or agency makes a booking:
• The advisor represents authority to bind the client
• The advisor is responsible for communicating all Terms
• FAMtastic Tour / Famtastic Tours is not liable for advisor misrepresentation
• Payment by advisor or client constitutes full acceptance
• FAMtastic Tour / Famtastic Tours may communicate directly with the traveler when authorized
Prices are based on current supplier contracts, fuel costs, exchange rates, taxes, and tariffs.
Prices are guaranteed after full payment except for:
• Government-imposed taxes or fees
• Mandatory supplier surcharges
• Significant currency fluctuations beyond our control
Airfare is subject to airline fare rules and is non-refundable once ticketed.
Deposits are required to confirm reservations.
Failure to pay when due may result in cancellation with penalties.
Airline tickets and travel insurance are non-refundable once issued.
Returned payments are subject to processing fees.
You agree not to initiate credit card chargebacks or payment disputes for services rendered in accordance with this Agreement.
Improper chargebacks constitute breach of contract and may result in recovery actions, including attorney’s fees, collection costs, and administrative expenses.
Cancellations must be submitted in writing.
Airfare is non-refundable once issued.
Land services are subject to published cancellation penalties.
No refunds for unused services after travel begins.
Refund Processing Timeline
Refunds, if applicable, will be processed only after receipt of funds from suppliers and may take up to 90 days or longer, depending on supplier remittance.
Any claim arising from travel must be submitted in writing within thirty (30) days of completion of travel.
Failure to provide timely written notice constitutes waiver of the claim to the extent permitted by law.
Travel involves inherent risks, including illness, injury, death, crime, terrorism, political instability, remote medical access, and natural disasters.
You voluntarily assume all such risks.
To the fullest extent permitted by law, you waive claims against FAMtastic Tour / Famtastic Tours for personal injury, property damage, emotional distress, or financial loss arising from participation in travel activities, except where it is prohibited by law.
FAMtastic Tour / Famtastic Tours is not responsible for failure or delay due to events beyond reasonable control, including but not limited to:
Refunds or credits, if any, are subject to supplier policies.
Travelers are solely responsible for passports, visas, vaccinations, and compliance with entry requirements.
Failure to obtain required documentation does not entitle the traveler to a refund.
Travelers are responsible for determining medical fitness.
Failure to disclose medical conditions may result in removal without refund.
Minors must be accompanied by a responsible adult.
Parents or guardians assume full responsibility.
Unless written notice is provided prior to departure, you grant FAMtastic Tour / Famtastic Tours the right to use photographs or videos taken during travel for promotional purposes without compensation.
Any dispute shall be resolved through binding arbitration in Orange County, North Carolina under the rules of the American Arbitration Association. Arbitration shall be conducted individually.
You waive participation in class, collective, or representative actions.
To the fullest extent permitted by law, you waive the right to trial by jury.
This Agreement is governed by the laws of the State of North Carolina.
If arbitration is deemed unenforceable, venue shall lie exclusively in the courts of Orange County, North Carolina.
Use of personal information is governed by our Privacy Policy, which is incorporated herein by reference.
FAMtastic Tour / Famtastic Tours operates in compliance with applicable laws and regulations of the State of North Carolina. North Carolina does not require a seller-of-travel registration for tour operators; however, FAMtastic Tour / Famtastic Tours conducts its business in accordance with all applicable federal and state consumer protection laws.
Electronic acceptance, digital signatures, and payment submission constitute legally binding consent.
If any provision is found unenforceable, the remaining provisions remain in effect.
Indemnification, limitation of liability, arbitration, and dispute provisions survive termination.
This Agreement constitutes the entire agreement and supersedes prior communications or representations.
